                                                                     Vancouver Bus Rider Blues

Bus riders beware. If you're injured on a B.C. Transit, Tranlink ( or whatever they call themselves) bus and there's even a hint of driver error, you'd better have your wits about you. Otherwise,  you can kiss your injury claim goodbye.

Recently, I've been hired by a number of folks who've been injured while riding on buses in the Lower Mianland. More importantly, a goodly number of these people seem to have suffered their injuries as a result of bus driver error.

Now, I'm quite certain that driving a bus in the Greater Vancouver area is a challenging way to earn a living. There's alot of traffic, tight schedules and probably a drunk or two to contend with as well. That being said, these bus drivers are supposed to be highly trained and willing to assume responsibility for the well-being of their passengers.

Do accidents happen ? Of course they do. And if accidents were treated as exactly that I probably wouldn't be writing this article.

But what I've seen developing in the recent past, is what can only be described as a deliberate attempt on the part of Translink and its drivers to evade responsibility for their own wrong doing.

What am I talking about ?

- Bus drivers who won't give their name or ID numbers to passengers;

- Bus drivers who cart injured people off of buses and don't give them information concerning their identity or bus number;

- Bus drivers who fail to take the time to see whether people are standing on their bus before they hammer on the binders;

- Translink investigators who arrive at the scene of a bus accident and fail to get the names of passengers who were on the bus (i.e. potential witnesses).

It goes on and on.

OK, you say. What should I do if I'm injured on a Translink bus ?

Here goes:

- Get the name and ID number of the bus driver;

- Get the bus license plate and bus route number;

- Get the bus ID number;

- Get the names, addresses and telephone numbers of passengers who witnessed your accident;

Don't get off the bus until you have all this information. Whatever you do !

Without all of the above, you'll have a heck of a time making a bus injury claim with ICBC.
