Ok - so the driver who crashed into your bike ( and sent you flying) wasn't given a ticket by the police. Will this affect your bike injury claim? Will ICBC say; " No ticket - No claim?" You want the long anwer or the short one? Alright. I'll cut to the chase. The fact that the police officers who arrived at the scene of your bike accident didn't issue a ticket to the guy who ran into you DOSEN'T mean much. NOW DON'T MISUNDERSTAND. Would it be a positive indicator if a police officer had issued the driver of the car that hit you a ticket? Of course. BUT, police officers don't commonly issue tickets after an accident. AND even if a police office does issue a ticket, their conclusion ( opinion) concerning who was at fault for your bike accident isn't "admissable evidence" in a court of law ( i.e. if your case goes to trial the judge won't take into account the fact that a ticket was issued). The bottom line here is that the BEHAVIOR of the driver is what really matters ( the manner in which he/she operated his/her vehicle). NOT whether he/she received a ticket.
