How long is it going to take to wrap up my ICBC injury claim ?

That's a question I hear day in and day out. And it's a good question. But it's a tough one to answer.

That being said, I'm going to try and "give you the goods".

There are three main factors I look at when I'm giving a client advice about how long it's going to take to resolve ( most people hear the word "settle") their ICBC injury claim.

Firstly, I look at the type of injury that they've suffered.

Second, I look at the impact their injuries have had on their lifestyle.

And third, I look at the duration of their injuries.

So, I'm going to give you an "insider's" look at each of these factors.

Injuries, what am I talking about when I reference the "injury" factor ? Well, have you suffered a whiplash? Have you broken some bones ? Or are your injuries in the "very serious" category such as a spinal cord injury or a brain injury ?

You see, each of the injuries I've referenced are very different and the length of time it takes to resolve an ICBC injury claims is usually directly linked to the type of injuries they've suffered.

Impact on lifestyle, what's this all about ? Well, first off, I'm talking about your ability to work. Can you go back to doing the same type of work you were doing before your accident ? Are you able to remain at the same job but  only able to perform  modified duties ? Are you only going to be able to work part-time ? As you can see, there are significant questions here.

In addition to how you earn your living, lifestyle also needs to take into account your "fun". Recreational activities such as your sports, hobbies etc. Are you back into the "fun" things you enjoyed before your car accident or are you still having problems or limitations of any kind?

Another lifestyle issue that needs to be considered are your domestic duties - cooking, cleaning, laundry, grocery shopping, gardening, mowing the lawn etc. Where are you at in terms of being able to do there types of things ?

The duration of your injuries is also something that we've got to take a close look at. Did you suffer from problems that lasted a few months or are you still having pain and difficulties despite the fact that your accident happened a few years ago? Or, does it appear that your injuries are going to be permanent ? Because these are all very different cases and this difference strikes at the heart of how long it's going to take to resolve your ICBC injury claim.

In summary, before I can look you in the eye and say, " we're in a good place to try and settle your case..." you need to be situated in one of two points on the spectrum. Either you're problems have gone away i.e. they've fully resolved. Or, we need to have an opinion from a medical specialist which says that your difficulties are going to be permanent. Because if you aren't positioned in one of these two places, you're in a no man's land. And I'm not going to be able to get you what's fair.
