How Long Do I Have to Settle my ICBC Injury Claim ?

How long due you have to settle your ICBC injury claim ?

In the vast majority of cases you have two years from the date of your car accident to  either start a lawsuit or settle your case ( note - there are some exceptions to this general rule).

This isn't a negotiable deadline. It's a line in the sand.

If you're going to start a lawsuit you need to ensure that it's done properly. In otherwords: have you sued all the appropriate parties ( i.e. people, companies, government agencies etc.)?; are the court papers prepared in the proper form ? have you filed the court papers initiating your lawsuit in the court registry ?

Assuming you get your lawsuit properly filed before the two year deadline, your case is still ongoing. In other words you get an extension and don't need to settle your case within the two year time frame.

If you HAVEN'T started a lawsuit and the two year time limit has come and gone, you're probably out of luck.

As far as settlement of your case is concerned, you need to ensure that a binding agreement has been entered into inside the two-year time line. In other words, the deal needs to be clearly understood. I'd strongly suggest that you get it in writing. Remember, talk is cheap.
