Hit by a car while working at 7-Eleven?
Strange but true.
It's an average day for the employee of the 7-Eleven located at No. 3 Rd and Blundell in Richmond.
When suddenly, out of the clear blue sky, a car rockets through a brick wall.
Right into the store.
And the 7-11 employee gets injured.
So, can the 7-11 employee make a claim through ICBC?
You see, because the employee was "working" at the time of the accident he/she is likely covered by the Workers Compensation Board ( WCB). So, I think it's pretty safe to say that he/she is eligible for benefits through WCB.
The missing piece of the puzzle is whether the driver of the vehicle which caused the 7-11 employees injuries was also "working" as the time of this accident ( delivering pizza, courier, etc.).
You see, if the driver of the vehicle was "working" then the ONLY option the 7-11 employee has is to make a claim through WCB.
But, if the driver of the car WASN'T "working" at the time of the accident.
Then, Mr./Mrs./Miss 7-11 employee has a CHOICE of claims.
He/She can choose between making a claim through WCB or making a claim through ICBC.
