Alright, so you were crossing the street and got hit by a car.
And you got hurt.
Do you have a viable ICBC Injury Claim??
Not so fast!!
You see, it takes more than getting hit and getting hurt.
In order for you to have a viable ICBC Injury Claim you need to be able to PROVE that your accident was due to someone else's negligence.
I'll try and keep it simple. It's a legal term to describe careless behavior that causes an accident.
Keep in mind that fault, in the context of a pedestrian injury claim, isn't necessarily an all or nothing proposition.
Sometimes the circumstances of a pedestrian accident dictate that both the pedestrian and the driver of the car involved both contributed to the accident. This is what's called contributory negligence on the part of the pedestrian.
I'll make a long story short.
If ICBC can prove that a pedestrian's actions contributed towards their accident the pedestrian's injury compensation is discounted in keeping with their degree of fault.
The bottom line here is simple.
In order to have a viable pedestrian injury claim you need to be able to prove fault on the part of the driver who hit you.
