Authorizing ICBC to Obtain Your Medical Records
AUTHORIZING ICBC TO OBTAIN YOUR MEDICAL RECORDS
DO YOU KNOW WHAT YOU'RE DOING ?
So you went into ICBC and you met with an adjuster. I'll bet the first thing he asked you to do was tell him about how your accident took place. And after that he probably asked you if you'd been injured and to tell him a little bit about how your injuries were affected you.
I suspect that the next thing the adjuster did was type out a "statement" which he had you sign.
And then he had you sign a form called as medical authorization. No doubt the adjuster said this medical authorization allowed ICBC to get your doctors records so ICBC could, "pay you a fair settlement..."
OK. We'll let the whole fair settlement thing go. That's a topic for another day.
What we need to discuss is the "medical authorization" which the adjuster had you sign.
Are you aware that ICBC's medical authorization allows them to get ahold of any and all of your medical record ?. In other words, did you know that the medical authorization you signed enables ICBC to obtain your medical records from your date of birth forward ?
Here's the thing. The medical authorization you signed allows ICBC to dig through your medical history. And what you need to understand is that with the use of this authorization ICBC can uncover potentially embarassing or private medical issues which have no connection to your accident injuries. Additionally, ICBC could use this authorization in an attempt to exploit medical condtions which you may have suffered from in the past that have long since resolved.
The bottom line is pretty simple. When you sign ICBC's medical authorization you toss away all the privacy protections that court decisions preventing ICBC from mining preaccident records provide
